1. Introduction
Welcome to GR Tech Swap LLC ("Company", "we", "us", or "our"). These Terms and Conditions ("Terms") govern your access to and use of our services, including any content, functionality, and services offered on or through grtechswap.com (the "Website"), as well as any other interactions you may have with GR Tech Swap. By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our services.
2. Services Provided
GR Tech Swap specializes in the acquisition and resale of phones, laptops, smartwatches, cameras, game consoles, and other electronic devices ("Products"). Our services include, but are not limited to, the appraisal and purchase of devices from local sellers and the resale of these devices to businesses and consumers.
3. Product Conditions
GR Tech Swap buys and resells devices in all conditions, including but not limited to new, new in box, open box, like new, used, cracked, scratched, dented, broken, damaged, and parts-only devices, as well as account locked and blacklisted devices. Account locked and blacklisted devices are only purchased when the seller provides reasonable assurance the device was legally obtained. A bill of sale is required for all transactions. Each product listed for sale will include a description of its condition. We make every effort to accurately represent the condition of our Products but cannot guarantee descriptions are error-free.
4. Purchasing Terms
When you sell a device to GR Tech Swap, you represent and warrant that you are the legal owner of the device, or are an authorized representative of the legal owner with full permission to sell the device. This includes but is not limited to parents or guardians selling on behalf of minors, business representatives selling company-owned inventory, and organizations or establishments selling unclaimed property in accordance with applicable Michigan law. You affirm that the device is free from any legal claims, liens, or encumbrances. A valid ID and signed bill of sale are required to complete any transaction at GR Tech Swap's discretion. Documentation requirements may be waived or substituted for established repeat customers, business partners with existing invoicing arrangements, or other circumstances at the sole discretion of GR Tech Swap. GR Tech Swap reserves the right to refuse the purchase of any device that does not meet these criteria and bears no liability for transactions where the seller has misrepresented their ownership or authority to sell.
5. Pricing and Payment
All transactions are conducted in U.S. dollars. Prices for our Products are subject to change without notice.
For sellers: GR Tech Swap pays sellers on the spot at the time of the meetup. Payment is issued via Venmo, PayPal, CashApp, or Apple Pay. Cash payment is accepted at the sole discretion of GR Tech Swap. All offers are based on the condition and description provided by the seller prior to the meetup. If a device is found to be not as described (INAD) upon physical inspection, GR Tech Swap reserves the right to adjust, reduce, or rescind the offer entirely. GR Tech Swap will only purchase and pay for devices that were explicitly agreed upon prior to or at the time of the meetup and reserves the right to decline purchase of any device that was not part of the original agreement.
For buyers: We accept payment methods as specified at the time of purchase, including but not limited to those available through our website and any integrated third party platforms such as eBay. Payment must be received and verified before any product is shipped. This requirement may be waived at the sole discretion of GR Tech Swap for established repeat customers and business partners with existing arrangements.
6. Shipping and Handling
GR Tech Swap ships domestically and internationally using various carriers including USPS, UPS, and FedEx. Free shipping is offered on the majority of orders. GR Tech Swap reserves the right to charge shipping on oversized, heavy, or otherwise exceptional items at our discretion.
Once a package has been dispatched and tracking has been provided, GR Tech Swap is not responsible for carrier delays, misrouting, or any other issues arising after the package leaves our possession. All items are carefully and thoroughly packaged to minimize the risk of damage in transit. In the event of a lost or damaged package, GR Tech Swap will make reasonable efforts to assist in resolving the issue with the carrier but cannot be held liable for losses that occur after dispatch.
For shipments through third party platforms such as eBay, the platform's respective shipping and dispute policies may also apply.
7. Returns and Refunds
All sales are final. GR Tech Swap's inventory consists of a mix of new, used, and broken electronics. Used items are pre-owned and may exhibit signs of normal wear including but not limited to light scratches, scuffs, or cosmetic imperfections consistent with prior use. Broken and damaged items are sold strictly as-is for parts or repair purposes. This is the expected and accepted nature of pre-owned inventory and does not constitute grounds for a return.
GR Tech Swap thoroughly photographs and describes each item prior to sale to accurately represent its condition. By completing a purchase, the buyer acknowledges and accepts the condition of the item as described.
The only grounds for a return or refund is if an item is materially not as described (INAD). If you believe your item was not accurately represented, contact us at [email protected] to initiate a review. GR Tech Swap reserves the right to assess and determine whether an INAD claim is valid at our sole discretion.
New, sealed, or new in box items may be eligible for a full refund only if returned in the exact same condition in which they were received, including original packaging and seals intact. Any signs of opening, tampering, or use will void eligibility for a refund.
GR Tech Swap is not responsible for the outcome of any repair attempts made by the buyer or a third party after purchase. Failed repairs do not constitute grounds for a return or refund under any circumstances.
For purchases made through third party platforms such as eBay, the platform's respective return and dispute policies may also apply.
8. Warranty
GR Tech Swap offers no warranty, expressed or implied, on any item sold. Pre-owned electronics carry inherent risks associated with prior use, age, and remaining battery or component lifecycle. GR Tech Swap makes every reasonable effort to inspect, test, and accurately represent the condition of each item prior to resale but cannot guarantee future performance, longevity, or compatibility. Buyers accept full responsibility for the condition and performance of items after purchase.
9. Limitation of Liability
GR Tech Swap LLC, its affiliates, contractors, partners, and their respective officers, directors, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use our services; (ii) any conduct or content of any third party in connection with our services; (iii) any content obtained through our services; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort including negligence, or any other legal theory, whether or not we have been informed of the possibility of such damage.
10. Intellectual Property
The content on our Website, including without limitation, the text, software, scripts, graphics, photos, sounds, music, videos, and interactive features, and the trademarks, service marks, and logos contained therein, are owned by or licensed to GR Tech Swap, subject to copyright and other intellectual property rights under United States and international laws and conventions.
11. Privacy Policy
Your privacy is important to us. Our Privacy Policy, which is incorporated into these Terms by reference, is available on our Website. It describes how we collect, use, and protect your personal information.
12. Changes to Terms and Conditions
We reserve the right to modify these Terms at any time. Changes take effect immediately upon posting to our website. Continued use of our services following any changes constitutes your acceptance of the revised Terms.
13. Governing Law
These Terms shall be governed and construed in accordance with the laws of the state of Michigan, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
